Agreement to Terms

This Terms of Use agreement (the "Terms") constitutes a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Octopus Creative Inc., doing business as Canadian AI Guy ("we," "us," or "our"), concerning your access to and use of the Canadian AI Guy website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site” and "Services").

By accessing the Site, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these terms, then you are expressly prohibited from using the site and must discontinue use immediately.

Intellectual Property Rights

Unless otherwise indicated, the Site and Services are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

User Representations

By using the Site, you represent and warrant that:

  1. All registration information you submit will be true, accurate, current, and complete.
  2. You have the legal capacity and you agree to comply with these Terms of Use.
  3. You will not use the Site for any illegal or unauthorized purpose.

Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Prohibited activities include, but are not limited to:

  • Engaging in any automated use of the system, such as using scripts to send comments or messages.
  • Interfering with, disrupting, or creating an undue burden on the Site or the networks connected to the Site.
  • Attempting to impersonate another user or person.
  • Using any information obtained from the Site in order to harass, abuse, or harm another person.

SMS/Text Messaging Terms and Conditions

By providing your mobile phone number on our Site, you agree to the following terms regarding SMS/text message communications:

  • Consent to Receive Messages: You expressly consent to receive recurring automated promotional and personalized marketing text (e.g., SMS and MMS) messages from Canadian AI Guy, including messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up.
  • Opt-Out: You can cancel the SMS service at any time. To unsubscribe, text “STOP” to the short code or number from which you are receiving messages. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
  • Help: For assistance, text “HELP” to the number you are receiving messages from. You can also obtain help directly by emailing us at he*@***********uy.ca.
  • Message and Data Rates: Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, please contact your wireless provider.
  • No Guarantee: We and the wireless carriers are not liable for delayed or undelivered messages.
  • Privacy: Your privacy is important to us. Please see our Privacy Policy to understand how we collect and use your personal information in relation to our messaging services.

Governing Law

These Terms shall be governed by and defined following the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You irrevocably consent that the courts of British Columbia shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

Disclaimer

THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF.

Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Changes to These Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms of Use.
